Order of the immigration judge for asylum — "Withdrawn"
Hi everyone,
I don't really expect too much because immigration court is not discussed all that much in here, but I am in a precarious situation and I would very much like your input if you have any insights.
I am in immigration court (U.S.) for asylum/removal proceedings, but neither I nor my lawyer received a letter to appear in the court (not even for a master calendar hearing, despite my checking the online docket and via telephone every month). The only letter they sent me says that the date is TBA (and that was in December 2020). Then, this week, I received a letter from the immigration court that states the following:
## ORDER OF THE IMMIGRATION JUDGE:
- It is hereby ordered that the applicant's request for:
- 1. Asylum is:
- [ ] Granted
- [x] Withdrawn - deemed abandoned for failure to appear
- [ ] Denied
- 2. Withholding of removal under INA 241 (b) (3) is:
- [ ] Granted
- [x] Withdrawn - deemed abandoned for failure to appear
- [ ] Denied
- 3. Withholding of removal under the convention against torture is:
- [ ] Granted
- [x] Withdrawn - deemed abandoned for failure to appear
- [ ] Denied
Appeal: No Appeal
In Asylum-only proceedings
I am still in shock and do not know why and how this has happened. I honestly did not receive any letters. Even their telephone hotline said that they would notify at least 10 days prior, due to COVID changes.
Of, course I am speaking with a lawyer this week but until then I am freaking out and I do not trust him too much so I really need to look for someone more competent.
Does anyone know if I can re-open the case, I.e. via a motion to re-open (so that I can start getting ready?)
Any other info is much appreciated.
