IA few questions about immigration from USA to Belgium

I am approaching a move to Belgium so a partner and I can live our lives there together. I have looked into several possible ways, but I'm seeking advice and I have questions. I have secured decent funds. I have about $6,000 with more before I plan to depart which is scheduled for December 12th. I have a passport that will remain active for many years. My partner's family is extremely supportive and is offering me a place to stay as well as help eith enrolment. I cannot qualify for cohabitation currently. It seems best that I try to enroll in schooling there and obtain a student visa. I have been learning Dutch for about 95 days. I'd have to study courses in English. I have not studdied post-secondary education yet. I've started applications and tomorrow I'll ask for my high school transcripts. I'm afraid of being denied on a visa application. I'm also afraid that it may he improper that I move there and apply for the visa afterwards. The Belgian embassi

K1 visa -- "Three or more arrests or convictions"

Exact question: "Three or more arrests or convictions, not from a single act, for crimes relating to a controlled substance or alcohol?" There were two incidents where I was arrested for drugs. These arrests resulted in two misdemeanor convictions. Does 2 arrests + 2 misdemeanor convictions = 4? Seems like it's asking about three or more incidents. submitted by /u/Tripl3b3am [link] [comments] source https://www.reddit.com/r/immigration/comments/qk2s4v/k1_visa_three_or_more_arrests_or_convictions/

Passport renewal for kids

My kids’ Indian passports are about to expire. We are currently in US. Their i-485 is under process. I see that Embassy needs valid immigration papers. Can I file for renewal or wait till they get GC. Hey guys, have a question for a document required for the forms mentioned above, I’m doing the process for my mom to get her green card. My question is regarding birth certificate from another country. ESTA visitor after their daughter adjusted status from a non-immigrant visa?

A friend of ours adjusted status from a non immigrant visa years ago after meeting someone (J1, B1, then got married and decided to stay on one of the visits and adjusted and is now LPR for several years). Her parents want to visit via an ESTA now that borders are reopening. Will this end up posing an issue? Would you recommend they apply for a visitor visa (even though their country of origin is on the ESTA list) for the opportunity to show more ties to their home country (two homes, a business, etc..)? submitted by /u/GNU_Yorker [link] [comments] source https://www.reddit.com/r/immigration/comments/qk29he/esta_visitor_after_their_daughter_adjusted_status/

Registry Date

hey guys, so many of you may already know democrats are trying to change the registry date to 2010. I was hoping somebody could help me with a question I have. if this change would pass, could somebody who went to elementary school for the 2009-2010 school year be eligible if they left the country for the summer of 2010 and came back in less than 2 months? I noticed the current registry date have the word "continuosly" and on the criteria to become a citizen, it says continuosly means to not have left the country for more than 6 months as a green card holder. I know this is two different things, but I was hoping it could apply the same thing to the registry. I left the country with my tourist visa up to day, and came back with visa too but overstayed it. thanks submitted by /u/ricaxrdo [link] [comments] source https://www.reddit.com/r/immigration/comments/qk11nz/registry_date/

ESTA denied?

Hi everyone. I'm a UK citizen and I have travelled to the states 3 or 4 times on an ESTA. Once in 2018, once in 2019 and once in 2020. Its worth mentioning that I travelled in Feb 2020 for 3 weeks but was stuck until May because of covid. I am aware that there is a 90 day cycle for visiting. I'm not sure if this classes as overstaying. (ETA: I had to stay until May - the airlines kept delaying my flights, I could not be repatriated, I had no money to book elsewhere, airportd were locked down here etc etc. Basically saying, I would have left after the three weeks had that been an option. My return tickets were booked.) (ETA: DECEMBER 2019 I was there 12 days FEB TO MAY 2020, I was there for 62. That doesn't go over the 90 days, so maybe it's not overstaying?) I also applied for a spousal visa. My ex husband is American. I got as far as rhe medical and interview stage. My interview was approved pending the medical. As I have mental health issues (specifically bipolar),

Thinking of returning too soon?

I am a UK citizen who recently had a 90 day stay in the US from July to October under the visa waiver program; my wife who is a US citizen applied for a visa to move to the UK with me whilst I was there and that is where we are now living and beginning our married life together. My wife's mother lives alone and because I have some time off at Christmas from my studies we were thinking about going to spend the holidays with her, we would be there for approximately 32 days and then return home. I understand this may be an issue as I would have only been out of the US for 2 and a half months before trying to return. What I am wondering is if my wife having a UK visa along with my studies be sufficient proof to immigration that I am not going to overstay? We would be going through pre-departure immigration at Dublin airport as I live in Northern Ireland. Thank you in advance! submitted by /u/j_blues [link] [comments] source https://www.reddit.com/r/immigration/comments

K1 Visa Postponed

My fiance (from Argentina) and I applied for the K1 visa process, and we received our NOA2. He still hasn't registered for an interview yet. Due to a family death, we decided that we would postpone our wedding in the US. Is it possible to wait a few months or a year and not jeopardize our paperwork? Travel outside of US with pending I-485 and E2 visa?

Hi all, Is it possible to travel outside of the US with a pending I-485 for short family visits of 1-2 weeks? Will I be overusing my B1 visa for very short but fairly frequent trips?

Currently I have been working remotely with a US company for a few months. I am considering my options to come to the US for meetings and contract negotiations. I currently have a B1/B2 Visa and I may want to visit once or twice a month for specific meetings and contract negotiations. No longer than 2-5 day stays at a time. How frequently can I make short trips of this nature while staying within the guidelines of the B1 business visa? I am considering once or twice a month (for 2-5 days at most) at a time, for a few months. If that is possible is that something that can be done for 1-2 years if so long? I do not imagine I will need to do this for that long but I am curious as to what is permitted. submitted by /u/Miss_Development_47 [link] [comments] source https://www.reddit.com/r/immigration/comments/qjmx15/will_i_be_overusing_my_b1_visa_for_very_short_but/

Opinions needed.

Hey yall. So I completed my bachelors degree from Arizona State University. (Senior year online). Almost a year ago, my US f1 visa was cancelled on Port of Entry due to involvement in off campus employment. I did re-apply since I was not barred from applying again but I received a refusal from the embassy under 214(b) after administrative processing. I had to stay in my home country so I started a job here since I could not see any possible chances considering my situation. A few days ago, my employer discussed an opportunity for a master's program from USA to which I was skeptical at first, but since the employer has agreed to sponsor me for tuition and residence provided I return back to Pakistan to rejoin the company. I decided to apply for graduate programs (USC marshall, Columbia, and UCLA) since I graduated magna cum laude and have a GRE score of 326. My question is, should I have any hopes for a visa for masters or is it just a lost cause? The only circumstances that have

Traveling with Married Name on GC and Maiden Name on Home Country Passport

Ok this might be a doozy. Got married, changed me name after the fact (ie didn’t change on the marriage certificate) through local court system. My GC has the new married name, but not a US citizen yet so still have my home country passport. My home country won’t recognize my married name because it was changed through US court. So as a compromise, the ID page on my passport still has maiden name but the next page is an endorsement that says “this person also goes by [married name]” For traveling to Mexico, would it be enough to have my green card, my passport, and a certified copy of the name change court order? What should the name on my airline ticket be? (Going to apply for citizenship ASAP so I can leave this name headache behind, btw) submitted by /u/cherry_chocolate92 [link] [comments] source https://www.reddit.com/r/immigration/comments/qjfhfp/traveling_with_married_name_on_gc_and_maiden_name/

Marrying German fiance in the US

Hello there, My boyfriend will be visiting me here in the US in Germany (we are currently long distance). He's obviously German, and I am a US green card holder (my nationality is Indian). When we get married in November, would the marriage be recognized in Germany, since the marriage is taking place in the US? Also, how would this affect tax returns and stuff? I am thinking of getting a job soon, so would the marriage affect filing taxes on my income here? He doesn't have a regular job, and runs a woodworking business in Germany. Another question I have is if he will get a green card through marriage. One more note I'd like to add is that the German embassy in my city (Seattle, WA) is not functional currently, and the only other embassy I can go to is in San Francisco which sucks, but hopefully I don't have to go to the embassy to get married lol. Thank you, and my apologies if this is the wrong place for a question of this nature. submitted by /u/coerced__

Is there a way I can move to US

I'm a 19yo Romanian who wants live and work in the United States and I want to know if there is a way I can do it. I tried to see if my grandmother in law could take me, since she has citizenship but it seems like she can't and I tried with going on a greencard site early this month and a few days ago I was called by a Florida number, and the guy asked me some of the same questions I gave on the site. He asked me if I'm married or have a criminal record and stuff, and after that we began to not understand each other that well and the. last thing was something along the lines of "are you expecting a mail from the government" and I was like "I don't know for sure how this works" then after a bit of more talk he said he wishes me luck with my visa and I don't really know what that really means for me or for the possibility of me getting to USA.. All I want is to go live and work there and I don't really have anyone that can help me like family

Where to turn in paper I-94?

I had a H1-B transfer with I-797A notice of action. Attached was a new I-94 departure record. On the back of the I797-A it reads that I need to turn in this I-94 to CBP before I depart United States. I'm flying out to Canada and a bit confused about the steps. Do I before going through airport security look for CBP office and turn it in? Or do I turn it in to the Canadian border services agency? Single entry J1/2 visas and reentry

This might be a stupid question but I can't find the answer anywhere. We are currently in the USA on single entry J1/J2 visas issued via the national interest exemption. We want to travel back to our home country for a family event. Is it correct that we would need to travel back to our home country, and only then could we apply for a whole new visa before we would be able to reenter the USA? Can the J1 holder leave the country for the event and leave the J2s in the USA? Would each person need a new visa in this situation? I can't get my head around this process. Help figuring my options out here. I'm a US Citizen, Fiance's a Portuguese Citizen living in Germany.

Howdy y'all! We're in a long term relationship and wanting to continue our lives together in the States. We're trying to figure our best gameplan here for my fiance and I to: Get married. Get her Green Card. We have a visit this coming January, and as I understand it we should avoid being married on a tourist/visitation visa as that would complicate a future K1. After the visit, we plan to start the K1 process. Was wondering if anyone has any experience in saving time legally here, we're not wanting to risk anything here as steep the waiting times seem to be. I understand some countries like Germany allow marriage to be filed without one party being present if the other has power of attorney. Would it be wise to do that for the sake of having the k1 fee waived or is there a hitch I'm not seeing in that? US visa appointment without copy of previous visa extension?

I went to the US on an H2B visa in 2017. Before my season ended, I extended my visa for another 6 months to work for a different company. My employer who filed my visa extension, never gave me my extension approval notice (I-797A). I contacted my employer for a copy of that document, as I've applied for a new H2B visa and I need a copy of all previous visas and visa extensions for my visa appointment, which is in 2 weeks. I have a friend who I worked with in the US, who's current colleague also apparently lost her I-797A of her extension a few years back. She also applied for a new H2B visa 2 years back without her lost I-797A and her visa was approved. A few of my friends, who all went for their visas last year got asked for all their previous visas and I-797 of all their previous visa extensions. So my visa appointment is in 2 weeks and what do I do when the consulate officer asks me for my I-797 of my visa extension? And what's the chances that he will deny my visa be

DV lottery question

I applied again this year but did some digging in advance on what there is to be done in case you win (wishful thinking) and found out you are supposed to declare past employment history in the ds-260 form, the thing is I'm from a non EU country and I've worked 3 times in Italy, while I made sure not to overstay my visa (one of the times on a student visa as I was studying there), I wasn't exactly supposed to be able to work in Italy. The jobs were relatively simple (1 time dishwasher and twice receptionist), they pay you below minimal wage hence they don't hire locals (win/win), make up some fake internship papers and have your cost of living covered (housing and some times food too)So I'm worried if this affects my chances of qualification and if the uscis cares enough to look into this submitted by /u/Frosty_Viper [link] [comments] source https://www.reddit.com/r/immigration/comments/qj4iwm/dv_lottery_question/

Moving to America and living there while we “wait out” my wife’s green card process. Is this possible?

Little about my situation: Family of four (one more on the way); Myself and all children are US citizens with passports; We are applying for a spouse visa for my wife (only non-US citizen in our family); Currently on the documents review stage. In august we submitted all documents for my wife’s greencard; we just got a response a couple days ago and a couple documents need adjusting and there was a request for evidence as to the petitioner’s (me) domicile. Since we are living together as a family, I am obviously not domiciled in the USA and I only now better understand the weight of that issue. My wife currently has a valid tourist visa that she has traveled on before since our i-130 got approved and since the question of domicile has come up we were thinking of moving to the USA, found a place to live (i.e. re-establi

I need your opinion.

Hello all. I moved here in the US when I was 17, few days later before I turn 18. I was petitioned by my father. My father became a U.S. Citizen before I turned 18 and the law was if he petitioned me before I turn 18, I am automatically a citizen. However, when we were at the immigration department in LAX Intl airport, one of the consulate said I can’t be a citizen and I will have to wait 5 years to apply. He didn’t explain or said anything to us. We were also in a rush because we had to catch our connecting flight. When we arrived to our final destination, my dad immediately filed for my Citizenship, along with my SSN, and I also received my Green card. When we received the paperwork for my Citizenship, it was denied saying that we did not have enough proof of evidence. I am 25 now and I spoke to an immigration lawyer earlier this year and she told me that I am a citizen and I should just apply for a passport. However, I want to be sure and do the right thing. Any suggestions? Shoul

Options for undocumented person brought to the US as a child after 2007

I have recently met a friend of my kid who was brought to the US in 2009 at the age of 10 on a tourist visa, and who has been living here ever since. As far as I can tell, DACA doesn't apply to him since he arrived after 2007. Are there any options for getting some protections or the ability to work legally? He's currently in College, and I would like to help him if possible, but I have no experience with this. NVC residency documentation for Canadian PR

I sent my documents to NVC following approval of my I-140. As a proof of residency in Canada where I am to interview for the visa,I sent my confirmation of permanent residence ( COPR). Could have sent my PR card but it has about 3 months validity at this time and the requirement for identity documents is 6 months validity. The letter from NVC states that landed immigrant documentation is sufficient. My attorney has raised an inquiry as he believes this should suffice too. K-1 visa medical exam Canada

Hello I was wondering if any Canadians have any helpful experience with the k-1 visa medical exam preferably if you are closer to Toronto. I'm curious about the cost. Also how the interview process was for you and how long it took from start to finish from the process I know it will be a little different for everyone but a ball park range of time would be cool. DV Lottery Dependent Question

Hello y'all. I know someone who is trying to apply for the DV Lottery and she has a younger brother (younger than 21 still) that she cares for because he is cognitively disabled. The father is alive, the mom is not, and the father doesn't care for them anyway, the older sister is the primary caregiver for the child but does not have any legal rights to him. I intend to pursue another master’s regardless whether I win the DV-2023 or I go through the F-1 visa route. I believe an additional masters will be of value to my skillset. However, I am at a crossroads at this point. The questions I have are: Can I set in motion the process for the (DV) visa while I am completing the two year rule? Will applying for a Diversity Visa adversely affect my chances of obtaining an F-1 visa after completing the two year rule? If I don't get the (DV) visa, can the DV application be interpreted as intent of immigration, and do

K1 visas in Mexico now in Mexico City

Hello, I petitioned a K-1 visa in November 2020. It was approved by USCIS in July 2021. I was told K-1 visas are always done in ciudad Juárez, but mine stated Mexico City. K1 Visa vs CR1

(Background) I am US citizen and fiancé is Brazilian. She has one year of school left and is done at the end of 2022. We are thinking about doing either a K1 fiancé or a CR1. For either option we would submit in February/March of 2022. I am going to visit her again in January, and would get married if we decide CR1 is our option. We have all the documentation prepared for a K1. (Question 1) I see that K1 visas are taking much longer than normal times, is the CR1 also taking extreme times or is it the same? Which would be better for someone who is just looking to get their fiancé/spouse to US around the beginning of 2023 or end of 2022? (Question 2) Also if approved early on either how long does the fiancé have to organize their affairs? How to receive Canadian visa while in US?

My mom is a citizen of Bangladesh and applied for a Canadian visa 6 months ago online. She is currently visiting me in the US. Is there a way for her to receive/ collect (I’m not sure how it works, if it’s a paper that is mailed to her?) her visa in the US when it is approved without having to go back to Bangladesh, so she can travel to Canada from the US directly? Diplomatic Daca

I came in after 2001 but before 2005 with my parents and had A2 diplomatic visa status due to my father's job at country of origin's embassy. I am from Africa. I came in as a child age 6 yrs. My parents put down wrong information on paperwork when we were coming to the USA and added 1 year to my age. For example, if I am currently 27, paperwork says I am 28. We overstayed our visa (expired 2008). My i-94 was stamped with D/S. I got daca in 2012 when it first came out and have maintained it with no lapse ever since. I was technically 17 but due to paperwork error, I "officially" received daca at age 18 and 227 days. My employer wants to file Eb3 green card for me. PERM and i140 have already been approved. However, due to unlawful > 180 days, I am subject to 3 year bar. I am subject to 3 year not 10 year because unlawful presence accrues at age 18 and USCIS forgives 180 days or less. So I have 45 or so days unlawful presence counting against me. With current state

Am I not domiciled in the USA? Now what?

I have been living abroad for over ten years—purely independently; no American employer or military or anything like that. I always intended this to be a temporary move, so I still maintain: US mailing address (permanent residence/where I grew up) US drivers license (with above address) US bank accounts (same address as above) everything else I might need. My wife and I have been married for 6+ years (two kids, one on the way). We met and married all while I’ve been abroad. I left the USA in 2010, we married in 2015. We’ve visited the states a few times with her in a tourist passport. I am an American citizen by birth, and my kids are both American citizens. I have submitted all documentation to USCIS for my wife’s spouse immigrant visa and received a note that “petitioner may not be domiciled in the USA, please submit additional evidence.” It only seems now that I may not actually qualify to be “domiciled” in the USA…what do I do? Does the whole process have to start over?

TN visa POE choice

Currently working on TN in the US, but found a new job and starting soon. I’m applying in what I’ve heard is an easy category (attorney). I can choose to either fly to Buffalo (peace bridge) or to YTZ and apply at Newark when I’m back. I’ve heard that Newark is fairly straight forward? What’s your experience? It would be easier for me to do Newark because I won’t have to get a cab to peace Bridge from the airport, etc. On the other hand, in the off chance that the officer finds something wrong with my application, I have to then buy a ticket back to Canada… I used Montreal last time, but there doesn't seem to be an affordable direct flight now, so it's not an option for me. Hi there. My fiancé plans on visiting me soon to the US as we haven’t seen each other since the country locked down from overseas (Aus) last year. We have a K1 pending, it’s at the embassy but Sydney consulate has been closed since July. Question is, should I be worried they won’t be allowed in the US? ESTA Visa + Past US Work Visa Rejection

Hi all, I hope this is the right place to post this - but my bf is wanting to travel to the US with me in December. He is an EU citizen, and therefore qualifies for ESTA, except that he has a work visa rejection from the US from 2019. He was told that his visa refusal won’t block him from entering the USA after 1 year, but he just received a refusal for the ESTA. Now we are wondering, will he always have to apply for a visa just to visit the US? It feels like a forever penalty just for being rejected from a work visa.
