Withdrawal of AOS/EAD application

I am currently waiting to be scheduled for an interview on a AOS marriage-based application. Ending a relationship hard, and it's hard specially after moving countries and being in immigration limbo for so long. I've decided that I am leaving the relationship and also the country. ​ Before going to a lawyer for more advice, I wanted to run this through reddit first. Could anyone guide me as to what the easiest way to do this would be, without leaving any loose ends? 1) Annulment vs Divorce? (marriage took place in California) 2) How to let USCIS know that I'm not pursuing AOS anymore? My story about TN Rejection at Blaine POE

Throwaway here but wanted to share my experience at Blaine POE. I work as a SWE for a medium-size company in Vancouver, Canada. I was in the process of transferring to HQ in California and had paperwork prepared by lawyers for TN application. I have Canadian citizenship and have been working for the Canadian company for 3+ years. As far as I understand, since I am capable of doing this job I am qualified to do this job under the Engineer category under TN status. I asked my company about L1 visa but it seems like they don't do it. I drove to Blaine POE to apply for the TN visa. I provided my paperwork and was made to wait in the car. After two hours of officers asking the same questions like "What are you job duties, why are you qualified, etc". They asked me about why my employer didn't petition for L1 and I mentioned that I'm not aware and it seemed like the employer didn't do L1s. After about 2 hours of this, I was taken inside their building for 3 hours

Left US without AP, now case is ready for interview...

Hi all, Filed AOS for marriage in Oct 19, have been on valid work visa status in the US for many years. Have traveled twice since (for work and a funeral) while 485 was pending, always on emergency AP. In March, I needed to leave again (family emergency), but my emergency AP appointment was cancelled as that was the same day all USCIS offices closed due to COVID. Postponed my flight twice in order to get an emergency appointment, but USCIS were in shambles. They finally got back to me when I was boarding my flight... Does a Visa need to be stamped, in order to be valid?

I am currently in US under H1B. My company is allowing me to remote in from my home country (South Korea), so I am planning to fly back and remote from there for a bit. However, My current Visa stamp has been expired and My have been approved for my visa extension. But I wasn't able to get my visa stamped, so my approval letter is just sitting there. Also, US Embassy in South Korea has stopped taking appointments for VISA so I won't be able to get the visa actually stamped in my passport until they start taking appointments again. With these circumstances, If I work remotely from Korea, I will be working with Expired H1B Visa Stamp in my passport and approved Visa Extensions without getting stamped. F1 STEM student and got selected for an H1B visa.

Hello! I am a european citizen and started my OPT in February 2020 in a tech company in the US. Somehow I got selected at this year's h1b lottery and my company's lawyer gave me two options: change of status : I will automatically convert to H-1B on October 2020 consular notification : I will be able to finish my full period of OPT; and apply for a STEM OPT extension, which will give me an extra two years of work authorization before I must change to H-1B. they do recommend change of status . the company does sponsor green cards but it won't start it till the full h1b is almost over. I am conflicted in terms of getting 2 more years of f1 then move to h1b or move to h1b in October. TN Visa residency requirement in state of employer?

I'm a Canadian working in the US on a TN Visa. Is there any requirement for me to live in same the city or state as my employer? For example, say my company is based in NY but I want to live in California and work remotely. In a similar vein, would there be an issue with me spending a proportion of my time outside the US. For example, I work at a NY based company but split my time between the US and Canada equally. HELP - Is there anything an illegal immigrant can do in the US to become a citizen?

OKAY, so this is probably going to be very long, but please bare with me and please only give thoughtful advice. My on and off again boyfriend (27m) was born in Mexico and is an illegal immigrant living in the US. Before I continue this post, yes I have done plenty of research and I don't think he has many options, but I am wondering if there is a "gray area" or an inkling of hope/opportunity for him in this country with his situation. So, he came here when he was about 15. He came over like many do (with a small group of people, traveling on foot, only moving after the sun goes down, minimal water and food, and with a ride waiting for him over the border in Texas). His older brother was already in the US illegally and arranged for this to happen for him. I will not be too specific, but for most of his time in the US he has been living in the Chicago land area, which helps because they are considered very lenient and do provide some opportunity for illegal immigrants

Overstaying my OPT grace period

Due to COVID-19 I'm unable to get a flight back home. All flights including local and international have been halted in my home country. Therefore I'm overstaying beyond my grace period. [F-1 Visa] CPT For unpaid, remote work

International student here. If I am going to be doing unpaid, remote research with a professor this Summer, do I need to apply to and have CPT authorization? Can fiancee's travel with K1 from the Philippines during 60 day ban?

My fiancee's K1 Visa was approved and I was about to head to the Philippines to help her move out of her apartment, then fly back to the US with her. The day before my flight President Durerte lclosed down the Philippines to foreigners coming in and put most of the country on lockdown. Right now, my fiancee can barely leave her neighborhood to go grocery shopping. Getting to the airport would be impossible. We are hoping restrictions will loosen up in mid May. If so, will we have a problem getting into the US on her K1 visa with the ban in place? Should I at least meet her in Japan and fly back with her since she's never really flown before and is nervous about immigration and customs? We've both tried to call the embassy in the Philippines and dept of immigration here in the US, both are closed. Spouse has Canadian PR and I have an H1B in USA. Best options for us to live together and work together?

As the title says I have an H1B in USA and my spouse has a Canadian PR card. She can't work in USA until I have an i485 and I can't work (I think, correct me if I am wrong) until I have a Canadian PR or work permit. Was assaulted by visiting professor

I’ve made a throwaway account for this post as it’s a bit personal. I am a female in her early twenties who was raped in October of 2019 by a professor at Columbia university. I don’t want to get into the specifics of the event but after the assault I was apprehended by campus police as i was visibly distraught. Extremely long story short the campus police called NYPD and I was questioned. I gave the police my ID and told them my story but did not end up going to the hospital or filing an official report because of the way it was handled. I did not give the police his first name but did give details on his exact profession, nationality, etc. I had basic details from the professor which made it easy to google him and found out his last name. 8 months later I am coming to terms with my assault and have regrets for not filing an official report. So I have been together with the current company for nearly 5 years. We started green card sponsorship in 2018 and I am expecting to get it within May or June. I-485 - self-prepare or use a lawyer?

How does changing your address affect your N-400 application?

I heard you're not supposed to move to other city or state when before your interview because they'll send your application to a new USCIS office in your new address area. and there is a requirement that you have to live in the jurisdiction you're applying for for at least 3 months. My question is what if you move within the same county but different city? Example pasadena, ca to burbank, ca. Both are of Los Angeles County but different city. Question about Household Size in I-864 - Conflicting instructions

Question 1 asks directly for the number of applicants that the petitioner (my spouse) is sponsoring. The answer to that is 1 as I am the only one being sponsored. Then, Question 2 asks the petitioner to write 1 to include themselves, and Question 3 asks the petitioner to write 1 again if they have a spouse. Questions 4-7 asks for other dependents, which are not relevant to our case. However, in Question 8, the form asks you to declare the household size of the petitioner by adding the responses for questions 1 through 7 . This leads to a problem since I will be double-counted in Question 1 and in Question 3. Two I-765s submitted - first for OPT, and second through marriage. What happens now?

I have adjusted status from F1, my husband is a USC. We sent our application to the Chicago Lockbox on Oct. 17th, 2019. Our first NOAs took longer than a month to come. I did my biometrics on 12/09. Then radio silence until 1/15/2020. That day, we got a RFIE for my birth certificate and a joint sponsor. For the RFIE, they wanted a translation of the birth certificate, which I provided in the first place. However, the translation I provided was done by a translator in my home country who doesn't know how to do a translation for USCIS. They wanted something simpler, so I paid a translator here in the US to do it. My husband is my sponsor and he makes above the poverty line. Need some information about sponsoring my wife for a green card.

So I'm going to go into a bit of detail as much as I can and need some help here. I'm currently married and am not living with my wife as were going through a rough patch. She left me back in November and I've been in rehab since then. She is currently here in the US on an H1B visa and 3rd year OB/GYN resident. I am the son of Polish immigrants and the United States is technically the only country I know. My parents did a really good job (probably too good) at raising me as a Pole. In addition to my family, I grew up in a Polish neighborhood and my friends were always Polish-Americans. Right now I am 21 and next year I will graduate college. Hypothesis: The recent Executive Order is about increasing Employment based green cards at the cost of Family based green cards

As I was answering another poster about something, I realized what I was stating (that the EO was partly about gutting Family based immigration at the cost of employment based immigration) was not a conclusion reached by many observers yet. First, I am going to state some facts: 1) The vast majority of family based immigrant visas that are subject to quotas (i.e not Immediate Relative) are processed at consulates abroad. 2) The vast majority of employment based immigrant visas (all of which are subject to quotas) are processed as Adjustment of Status. 3) The recent Executive order by the president blocks immigrant visas processing at consulates abroad but does not impact Adjustment of status. 4) The immigration act of 1990 Section 101d states that any unused Family Based immigration visas are added to the employment based visas for the following year. 5) The president has previously expressed an interest in lowering family based immigration and increasing employment immigration.

Hi my mom who has had cancer since 2005 and who is terminally ill becusss of it wants to get a legal residence but right now we’re having financial issues. I recently got SNAP benefits but it only qualifies for me. Even though she does not have that help would they deny her based on that alone. I also get ssdi and Medicare since I’m also disabled mentally so I am not sure if that would also be considered. Help with I-864

I'm being asked to be the sponsor of 2 of my underage cousins and fill out form I-864 for each of them. Their mom(divorced from my uncle) came to the US legally by means of marrying a US citizen, she's applying herself to become a legal resident. The person that she's marrying doesn't have the means to sponsor both kids, only her. I'd like to help, and have enough income to sponsor them. However, I don't know the mom or the husband very well, and would like to know what are the implications of becoming a sponsor for the kids. I've done some research online about this, but couldn't find much when it comes to minors, one of them is 16 and the other is 13. AM I RIGHT TO BE MAD?

So I submitted my green card application on the 15th using an expensive lawyer which took Upto 6 months for them to complete all the forms, I got frustrated a lot of times cos they kept repeating things and keep asking me to give them paper works multiple times. TN-2 vs OPT

I'm Canadian and finishing up my PhD in a stem field at a US university. I have a promising job offer but they would like me to start in July, before I officially finish my degree in August. I'm being told conflicting info about whether it is better to pursue a TN-2 or apply for OPT. Some of the points that have been mentioned to me: -travel ban might make it difficult to do TN (not sure if it makes a difference that I could drive to a border crossing) -OPT processing time is 1.5 to 5 months, and if I'm not going to graduate until August I can't apply until May -I-129 processing time is 3 weeks to 4 months Would appreciate thoughts and general advice about how to know what the "right" thing to do is. Unauthorized Employment on Student Visa with Immediate Relative

Hello, I am an US born citizen. My wife is from South Korea and recently graduated from nursing school by being in the US for years on a student visa (I think OPT). We met in December and married early this month (April). We are wanting to apply for AOS and EAD for her. She is still located in the US on a valid visa. She has done some unauthorized work in the past. My understanding is that these bars are forgiven by the USCIS if the person applying has an immediate relative. We are planning to admit to the unauthorized employment. While it may be true that unauthorized employment with an immediate relative is forgiven, it is still consider illegal. Could there be any other consequences from the unauthorized employment even though she has an immediate relative? Could it appear on background checks when applying for jobs (nursing position)? Would this cause extra barriers when we plan to travel in the future to other countries? Would this void her education she earned with her studen

Due to the virus, life's been a bit harder for us. My husband is thinking about applying for SNAP. It asks for any household member's info which includes mine. How will COVID-19 affect our k-1 visa

Me (Canadian) and my fiance (American) applied for our k-1 visa application January 6th, got our first NOA (Notice of action) stating everything is correct and they will now look at the evidence of our relationship. Just our luck, COVID-19 strikes hard and fast, and now wr are left worried and concerned about oyr paper work and our process in general. How will this whole thing affect us? I have a flight booked to go see her June 29th - July 30th. I'm staying for a whole month. How much longer will out process take? Will I still gey approved? Granted Withholding and want to adjust!!

My friend came to the US legally as a child and had her green card from her parents. She got caught up with her boyfriends bullshit and was charged with fraud after applying for her N400. USCIS postponed her interview and never got back to her. She was eventually convicted and was served time. ICE picked her from the prison after serving her time and put her in immigration detention. she was charged with crime of moral turpitude and aggravated felony because the loss amt and resitution was over $10k.She was told the only relief she qualified for was CAT/witholding. She applied for that and Immigration Judge in PA granted her. She’s back home now and wants to know the next step and process to adjust back to her green card status and try to get her citizenship. Questions regarding extending my F-1 visa

Hello friends I'm currently in the US on an F-1 visa. I graduated from undergrad in June 2019. I am currently on a 1-year OPT that is valid until August. I have also been accepted to a PhD program that I am due to start in August, and I have initiated the SEVIS transfer process for that. Once I receive my I-20 I will be allowed to stay in the US until the program end date on the I-20, so my status in the US is secure. However, the F-1 visa in my passport expires in July. I've been told that this doesn't mean I can't stay in the US, and that the visa in the passport is only used for re-entry. I was told that I would need to apply for a new F-1 visa in order to be able to re-enter the country if I leave. I have been told conflicting things regarding the process for application of a new F-1 visa. I have an Indian passport, but I have lived almost my whole life in Singapore, and that's where my family is, etc. I was told by my DSO that I would only be able to apply

Approved Today! Marriage Green Card/AoS: My Timeline

OK so I'm hoping I'm not just counting my chickens but the "Check Case Status" on uscis.gov says: "My Case Was Approved On April 28, 2020, we approved your Form I-485, Application to Register Permanent Residence or Adjust Status, Receipt Number xxxxxxxxx]. We sent you an approval notice. Please follow the instructions in the notice. If you do not receive your approval notice by May 13, 2020, please go to www.uscis.gov/e-request . If you move, go to www.uscis.gov/addresschange to give us your new mailing address." Yippee! For those wanting to know, here's the info for my timeline and some tips from my point of view. Take them with a grain of salt as I'm no lawyer and did make some mistakes, but I didn't use an attorney and filed everything myself. Saved a fortune I'm sure. My father was told he was able to appeal his CFI Interview and the court said he could. He is now being deported to his country of origin.

My mother and father have been fighting their Asylum cases both in the US. Mom is in Pahrump, NV and dad is in Otay Mesa in San Diego, CA. Dad had an unexpected court hearing today for his Credible Fear Interview. He was denied but was told he was able to appeal. He was also told he would have another hearing for Bond and Asylum. Fast forward to two hours later, an inmate called me from where dad is saying that he has been removed from Otay Mesa Detention Center and is now being deported. My lawyers called the Courthouse, Deportation Officers, etc. and they told her that he DID NOT have an order of deportation and that he was NOT going to be deported. Why was he unlawfully deported? Is there anything that I can do regarding this? Timing spousal GC application to avoid conditional GC

My spouse (US citizen) and I got married in the summer of 2019. I obtained a 3 year H1-B visa at around the same time, and I moved to join her in the US. I was hoping to apply for a family-based GC at some point while my H1-B is still valid, but with enough lag so that we didn't have to go through the removal of conditions process. Green card renewal questions

I’m 24 years old, and I’ve been in the country for 20 years since I was a child. My dad became a citizen but because of divorce my mom refused to give him any information about me or what not. He’s not on my birth certificate either, so my siblings are all citizens. I had my biometrics on December. I owed taxes in 2018? And my green card was expiring soon. So I decided to reapply for it before heading over to my citizenship application. So April 2nd I sent in my tax form for 2018, and I’m still waiting for them to update it on their website so I know how much to pay including fees and etc. I plan on getting a lawyer to help me with my citizenship application, just to make sure everything goes smoothly. Potential Triple Citizenship

For context, my father was born in Mexico and lived there until adulthood. He got his American citizenship because my grandmother was born on US soil. My mother was born in Ecuador, attended college there, and later came to the United States. She took the test and was naturalized. LPR admission date for green card issued while abroad

Regarding change of status - H1B

I am on H1B cap exempt and a new employer is filing for change of status to H1B non-exempt. I passed the lottery last month. My current h1b is valid for another 2 years. I have a very strong reason (personal/ medical) reason to not change job till end of the year. I wish to start new job in January. I have couple of questions:- With change of status, can I continue to work for my present employer from Oct to December? Or I really have to jump to new employer in Oct?
