Hello, I entered US on H1b status in 2017 and was on H-1B status as recently as 2019, but as of August 13, 2019 I am on H-4 status. On February 29, 2020, I made a day trip to Canada and returned to the U.S. on the same day. I see now that the I-94 issued by CBP on February 29, 2020 indicated that I entered the U.S. on H-1B status, and not H-4 status. I visited CBP yesterday to resolve the I-94 issue but I was told that Since I only have H1B visa in my Passport but not H4(I just have I-539, cause I didn't go for stamping after getting converted to H4), when I left US to go to Canada, my I-539 became invalid and I don't have H4 Visa in my passport, I shouldn't even have been allowed to come to the US but the immigration officer must have made a mistake and they also told me that now I have to go to some other country to get my stamping done to get a new I94 with H4 status. When we were initially planning to go to Canada, we came across automatic revalidation and thought that it applied to me as well. On top of that I was allowed to come back to the US, so we didn't give it a second thought.
Already contacted few attorneys but all are saying that they don’t deal with this kind of issues.Any suggestions here?
