Here's the situation - 0have a green card petition pending for myself and my wife, I-140 approved and we got our EAD/AP cards this summer, only waiting for the I-485 to come through now. I am currently working on an H-1B visa, and my wife's H-4 just got approved too (we applied as a backup plan).
Now, we plan to travel abroad for the holiday season and consider our re-entry options. I will likely visit the embassy to get the H-1B stamp to keep the employment steady, but we're wondering if my wife should do it for her H-4 or skip the embassy and re-enter using the AP. She currently works on her EAD (in the c(9) category) and we worry that getting the H-4 might cancel that somehow. That's because while H-4s can get EADs while a green card petition is pending, it is of a different category, c(26). Applying for a new EAD and waiting a year is not worth it, but we're wondering if it's ok to work on an EAD that was granted under a different status?
We'll likely just use the combo card to be safe, but any thoughts or comments would be appreciated, thanks!
