I am a US resident and my girlfriend and I recently got married while her I-539 extension of her B-2 visa is still pending. I had consulted a lawyer regarding filing I-485 AOS and she got back to me today saying that she had heard that USCIS officer are now not allowing AOS during I-539 pending anymore and will deny her I-539 immediately upon receiving the I-485 application. As a result she will be out of status and won't be able to adjust her status since I am a US resident. Anyone know anything about this? As the lawyer said it is something she had heard recently but doesn't want us to take this risk and would prefer us to wait for the I-539 approval. But this is already my wife's 2nd I-539 extension and I am afraid she will be denied and we are left with no other option for AOS. Should I just go ahead and file the I-485? I feel like it is both a gamble and I would like some advice on which is the safer bet.
