Can I sue the NVC?

At this point, I'm convinced either they are negligent or malicious in their actions - is it possible to open a lawsuit against the NVC?

I'm at the NVC stage with my spouses I-130, and have now been delayed 3 times now with documentation. The first time, I admit I had submitted the wrong forms. But after calling and verifying that I did the submit the correct forms most recently. The NVC has come back with:

- I do not meet the income requirements (I do meet it, have submitted the correct I864, and even have the forms shown as accepted). I don't know why they don't think I meet the requirements all of a suddent.

- the Police Certificate for NZ is invalid. The first time around, we submitted the MOJ police certificate and was told that it was wrong. The second time around we requested it directly from the NZ Police to be sent to the embassy (per the documentation at their site https://nvc.state.gov/find ). I even called and verified that we do not have to submit it and should be marked as None. As a safeguard, I even filed the verification email from the NZ Police saying that its been requested and will be sent to the embassy.

N-400 form {"data":null,"error":{"developerMessage":null,"userMessage":null}} message

A few questions: I filed my N400 naturalization on March 23, 2020. Nearly one year later on Feb 2021 they sent me a notice that they'll reuse my biometrics from my green card application, but they won't refund the biometric fee! At the same time April 2021 showed up on my account as the expected completion date. Last week, the status was "17 days". Today the estimated time of completion has disappeared!!!
