Re-Applying for I-485 AOS for me and family, need some guidance

Hi there. I'd appreciate some guidance with filing my I-485 AOS for me and my family (wife and 2 children, all Canadians). We also have 2 US born children, if that has any bearing.

Some background:

  • My employer sponsored my PERM + I-140 (EB2) which was approved in Nov 2018.
  • We filed our I-485 and concurrent EAD/AP combo application in May 2019.
  • We received the EAD/AP approval and the combo cards in Sept 2019 but they expired in Oct 2020.
  • We had the I-485 interview in Nov 2019 and were rejected due to being sorely unprepared (long story, discussed in other threads, yes we are stupid and lawyer was too).
  • We are currently on valid H-1B/H-4 until Aug 2023 (originally went on H-1B back in 2017 so this is our last renewal).

Some questions:

- Do I need to mark the I-765 and I-131 applications as "renewals" since we did get approved and expired back in Oct 2020?

- I believe I'll need I-485, I-765 and I-131 for myself (employment sponsored applicant) but are the exact same forms required for my spouse and children OR are there separate forms for dependents for any of these?

- I've read contradictory articles about revised fees for concurrently filing the I-765 and I-131, where fees were originally not required when filed concurrently with I-485 but the Trump administration made some changes so that the additional fees are required now. However the USCIS "fee calculator" still indicates $0 if I'm filing alongside the I-485. Can someone please confirm?

- Would it help to include a cover letter with the package to explain why we failed the AOS interview?

Here is what we plan to include in the application package:

  • Form G-1450, Check, money order or credit card payment
  • Form G-1145, Request for e-Notification
  • Form I-485, Application to Register Permanent Residence or Adjust Status (times 4)
  • Form I-765, Application for Employment Authorization (times 4)
  • Form I-131, Application for Travel Document (times 4)
  • Form I-693, Report of Medical Examination and Vaccination Record (times 4)

Is there anything else we should include scans/copies of that might support or be required for our case?
