Mexican National Doesn't Know A#

So I am a PCR Paralegal for a non-profit. We unfortunately rejected a case from a Mexican National because he doesn't have immigration counsel. Now, my question is, how would he be able to get his FOIA without putting him on DOJs radar? He did his FBI fingerprints and theres a record showing he was deported but no récord of an A#. He has absolutely no immigration documents.

Is it safe for him to get his FOIA without being put in immigration proceedings? Is that something that is happening at all? He was two controlled substance concvictions from 1994.
