Hello! I’m a spouse of a US citizen and in the process of finishing up my I-485. Our I-130 got approved a while ago so we were pretty happy about that until we stumbled upon the word misrepresentation here on Reddit. I came here on a travel visa and my husbands military orders. At the port of entry my visa was barely even looked at and we were asked if we had already started the visa process. Our answer was an honest “no” and the guard then said “well you better hurry up while you’re here, the virus is delaying a lot of it” We didn’t think much of it, and started the process about a month after my arrival. Now.. the fact that I came here on a travel visa and then applied for immigration didn’t even occur to us as misrepresentation since we both didn’t know there is a special visa I should’ve applied for to come to America. We just didn’t know- at all. And that’s it. We clearly do now, though and are more than worried. Is there a way that we can prove how misrepresentation wasn’t our intention?? If we even get an interview? I just really need some positive words.
If only the guard would’ve stopped us or told us something in the very beginning. He didn’t even ask about our intentions here. (It is fully our fault and our responsibility, we know that. I’m in no way blaming the guard for anything. Just wanted to make that clear. Just very frustrated)
