Hello all, I am panicking a bit here. Just need to understand the implications.
My PERM processing was initiated in April this year(2021). And my wage determination was just completed and they are about to file an LCA. Realized that the wage level determination was done for level 2 (~$85,000) and they are failing LCA as level 2.
But when h1b was transferred to the company in Feb 2020, the wage level in the LCA was checked at Level III. Even the Prevailing Wage Rate(~$99500) recorded was just a level III wage which is just a little less than what they are paying me ($103000) now.
Will this cause issues? Any recommended actions?
