So I've dug around for an answer but I'm assuming nobody does this so it's not frequently considered.
My fiance and I currently live in Ukraine and intend to do so for the next few years.
I'm an American (and Ukrainian) citizen and she is a Ukrainian citizen. She really wants to visit the US and has been denied once for a work & travel visa and once for a tourist visa (I sent an invitation).
Since we're getting married anyway we figured it might be wise to apply for a K1 visa and get married in the US. Being that we don't intend to live in the US anytime soon we don't anticipate to apply for a green card. So what happens if we just get an American marriage certificate and don't do anything?
We would leave the US within 90 days and return to Ukraine to live. Can we apply for a green card base on that marriage certificate years down the line? Will having an American marriage certificate allow her to more easily get approved for an American Tourist visa?
Also side question: I have a underage DUI from 7 years ago that was expunged (Pennsylvania, I was 18). I'm assuming it's necessary to reveal this on my application regardless of expungement? Would this affect our chances?
