I came to US 2 years ago to attend a school on an F1 visa. My wife (USC) and I had no intention to get married when I first entered the US 2 years ago. We knew each other but started dating while I was living with roommates when I first moved here for 5 months. We then moved in together. I proposed to her 6 months later and she said yes. I continued my school and went to my home country for a vacation at the end of last year. I came back and we eloped more than a month later. Currently, i have finished school and I am working on OPT. We still haven’t applied for AOS and it’s been 6 months since I reentered and 5 months since we got married. What’s a good timeline to apply given that we did get married within 90 days of reentering? Can I extend my OPT for another 2 years (STEM) even when i have an AOS EAD pending once I apply in case I don’t receive my AOS EAD in time?
Edit: the office at reentry did not ask me anything but which school I was attending and asked for my i20. And no, I did not know about such a rule on F1 visa given that my thinking was still to finish my school and I wouldn’t want to change my visa status in the middle of attending a school.
