L1 Visa Ban exceptions

So my company from Germany offered me the chance to move to our US headoffices as soon as possible.

On the website of the us embassy in Germany I found the following regarding exceptions for the ban:

"Senior-level managers and executives, and their dependents, who provide strategic direction necessary for the success of the company or venture"

From my understanding Senior-Level in US-Companies means CEO, CMO, CFO etc., correct?

My position would be one level below as a General Manager - subject of my transfer to the US would be the assessment of the current team and potential need for additional headcount, as well as providing strategic direction corresponding to our work in Europe.

Would that potentially be enough for the embassy to justify handing out a visa before end of the year?

A few questions: I filed my N400 naturalization on March 23, 2020. Nearly one year later on Feb 2021 they sent me a notice that they'll reuse my biometrics from my green card application, but they won't refund the biometric fee!
