My H-1B was denied last year, and over half a year later, approved by USCIS after I filed a lawsuit because they misapplied the interpretation of specialty occupation. Now my H-1B is nearing the end of the 6th year limit. During the period between the denial and approval, I stayed in the US, and was not allowed to work and had no income. Has anyone had experience recapturing the time lost because USCIS had unlawfully denied H1b status?
