Do F4 Derivative Beneficiaries qualify for CSPA?

I am looking at these links about the 2006 case: Scialabba v. Vuellar de Osario

I am seeing mixed results on the internet super confused. Any clarity would be appreciated.

My Uncle applied for my dad(F4) originally. I live in the US now as a F1 student in OPT. And would have to go back for the interview.

Do I qualify for CSPA? thanks
