Hi - I created this account to ask this question
I am Canadian (born there) and entered the US to visit my parents who are permanent residents. I hadn't seen them in a long time so the plan was to stay for 5 months and then go back to Canada. After being here now almost 4 months - I am thinking I would like to apply for permanent residency and so do an adjustment of status. Is that allowed since I entered as a tourist?
I've read that you can't have had an intention to stay when you entered - and honestly I didn't even want to take the trip let alone stay - but once I have been here now for 4 months I've changed my mind. I've read that there are exceptions for immediate family members but I'm not sure I qualify as an exception.
I don't want to break any rules and I won't overstay the 6 month time I'm allowed to stay here if I'm not allowed to adjust status. But I thought I would ask here and see what you all had to say.
Or maybe even if its possible - would USCIS just deny me at my eventual interview anyway since they will probably believe I always planned on staying?
