My partner (UK Citizen) and I (US Citizen) have been together for about 2 years after meeting through working for the same company. We have been trying to figure out a way to be in the same country for over a year now, weighing our options in both the US and the UK.
Early this year, she accepted a role within the company that would allow her to finally move to the US with the company sponsoring her on an L1A visa. Her application was submitted and her appointment at the consulate in London scheduled for July 21 in the midst of the COVID19 situation. Around this same time, we found out we were expecting our first child to be due in early November. With the new EO issued this week, her appointment has been officially canceled and we are devastated.
While we absolutely intend to get married and have entertained it as an option to get her to the US, we initially held off on initiating the K1 or CR1 process to allow for the L1 to go through. In the absence of an L1 visa for the time being, I am trying to determine if there are any other ways for her to get here before she's due.
I am worried that a K1 or CR1 will take too long at this point in time. Would it be possible to get married either via non-military proxy marriage or in a country that is currently issuing marriage licenses to allow for her to be classed as the spouse of a US citizen and resubmit her L1 application under that exemption? Any input or suggestions are greatly appreciated!
