K1 Visa Circumstances - Really stuck on what to do

Hi guys.

You are all so helpful I really appreciate this community.

I need clarification and advice because honestly we're in a predicament.

Here's the outline:

Applied for K1 Visa Nov 2019. Approved March 2020 - forwarded to US embassy. Corona virus happened. I've heard nothing from the embassy at all, as is the case with many others. Application date on notice of action has now passed. I contacted the embassy asking them to extend it or make sure everything is okay and I got back canned answers from the website.

Looks like the travel ban effects people in UK.

K1 Visa is a non immigrant visa which is exempt from immigration ban... Except on the US Embassy London Website the K1 Visa is categorised as an Immigrant visa. See links below:

Other circumstances:

  • Fiance is currently with me in UK, has been here on Tier 4 student visa. Just finished her bachelors degree, her date she has to leave is October. Can she extend in some way if we can't get to the USA?

  • I can work from anywhere as business is online.

  • We are speaking to others who think it might be a year before all the bans are lifted, might be worth getting married, she stays here another year and we throw away the K1 and apply for a K3 spouse visa.

We're in such a predicament. I know no one really knows when the embassy will open, but can anyone offer any insight or guidance as to what options we have. Also, clarification as to whether the K1 is immigrant or non immigrant.

Thank you guys, I appreciate it a lot. This is so hard.
