If a person on H-1b visa is deported by CBP for overstaying on I-94, should their employer terminate their employment by law?
One of my friends working in the US on H-1b visa accidentally overstayed by around 3 months as per her I-94 record. Recently she had to travel to Mexico for a personal reason & when she returned back to the US, the CBP Officer noticed her overstaying record & forced her to return back to Mexico under "Voluntary Departure" condition. In this scenario, will her US employer be forced to terminate her employment now & re-hire her after applying for a new H-1b visa for her? Or can they continue to keep her employed even after she has left the US?
