I posted 2 days ago about wanting to return to my home country in December to change my citizenship and get a H-1B visa issued (I went through adjustment of status on October 1) on my new passport after the order expires on December 31.
I was concerned about leaving the U.S. in December because I was afraid that the visa ban would be extended, however after reading the order again I'm wondering if it applies to me at all. The first two conditions of the order on who it applies to are:
(i) is outside the United States on the effective date of this proclamation;
(ii) does not have a nonimmigrant visa that is valid on the effective date of this proclamation
Since I (1) have been in the U.S. this entire year and (2) held a nonimmigrant visa that was valid on the effective date of the proclamation (my F-1 visa, which expires July 2021, and a B-1 visa that expires April 2026), would the order not apply to me at all? Does the fact that these visas are on a different passport than what I would get my H-1B visa issued on matter?
