AOS or Consular Processing for Parents of US Citizen with health issues

Hello,

I am a naturalized U.S. Citizen and want to apply for Green Card for both my parents who currently reside in Mumbai, India. They currently possess a visitor visa for USA, and have travelled to USA multiple times over the last 15 years. We have a choice of either having them travel to USA and file for AOS here, or start the Consular Processing while they stay in India.

An important consideration is that my Dad has been having ongoing medical issues; he was recently hospitalized, and there's a possibility that he may need additional medical attention, including potential hospitalization, in next 12 months. All of my siblings reside in USA, and hence currently there is no immediately family members that can provide support for his ongoing medical issues. Our goal is to get our parents to USA as soon as possible, so we can take care of them.

Based on my research, AOS seems to be a preferred option since Consular Processing decisions can't be appealed. My primary concern is that I haven't been able to find any affordable medical insurance options that will cover his pre-existing medical conditions while we wait for his AOS application to get approved in USA. It seems like this process may take anywhere from 6 - 12 months before he gets his Green Card. My worry is that if he needs to be hospitalized during this time, we would end up racking a lot of medical bills. We want to avoid a situation where they may become "public charge" which may disqualify them from immigration. Note: Once they become permanent residents, we expect my parents to qualify for Medical (California) which should provide the necessary medical coverage.

Questions:

  1. Would it make sense for us to take the Consular Processing route, to make sure my Dad has access to affordable medical care in India, while his Green Card application is pending?
  2. Or does the risk of Consular Processing getting rejected out-weigh the concerns around medical costs. There is a very high chance that he will need medical care, with potential for hospitalization. There is a low chance that their CP application should get rejected since they have never out-stayed their visa, or violated any other laws. But I guess you never know.........
  3. Are there any other resources to get cheap medical care while he waits for his Green Card to be approved in USA (AOS option)?
