My wife and I got married this month. I'm a born US citizen, she was an international student from China. She's about to finish her first year of OPT and file for an extension this Sept. I keep reading about furloughs. Our plan was to have her apply for OPT extension and then she'll have two more years before we'll file for a Green Card. That gets us past the 2 year minimum. My concern is if we risk her Green Card application if she doesn't get the OPT extension and it gets denied *after* OPT expires (plus 180days) at end of year. I don't care if she can't work, I just don't want her to be out of status and ineligible for the Marriage Greencard. I don't want her to have to leave. We have a local, certified marriage license. Should we go ahead and apply for the Green Card (in Nov to be past 90 days) to be safe? - I believe just having that application submitted protects her. Would anyone have any advice? Should I talk to a lawyer?
