Hi Everyone,
I'm currently a valid H1B holder in the U.S. and on the path to Green Card (fingers crossed) with a priority date of November 2019.
My mom and my sister are B1/B2 visa holders with a 10 year multiple entry provision.
Due to my dad unfortunately passing this year, I'd like for the two of them to stay with me in the U.S. from time to time. As I understand the B1/B2 visas only allow you to stay in the states for 6 months at a time. Is that a cap for the full calendar year or just one continuous stay?
Essentially, just trying to figure out hypothetically if they were to stay with me for say 4 - 5 months in a give year, travel back to India for day about a month could they then come back again within the same calendar year and stay with me for another 4 - 5 months? Would bring their total stay in the U.S. up to 8 - 10 months in this example.
I'm trying to avoid them falling out of status or violate any laws naturally. For background my mom's 56 and a homemaker. My sister is 32 and is currently unemployed. I'm 29 and have been in the U.S. for 11 years (4 years on a student visa + a year on OPT + 7 years on an H1B)
I know those factors can matter sometimes to CBP officers. Appreciate any sage advice the community has to offer!
