Hello,
We are nearing my visa status end date and our lawyer has not been very helpful. So we are asking this here.
My spouse is applying for my green card but his forms asks about his certificate of naturalization.
He got citizenship as a child when his parents naturalized and became citizen. He has a valid US passport but doesn't have a certificate of naturalization. What's more, his parents lost their certificates after they became citizens more than a decade ago.
My questions are:
-
Does my spouse need to wait for his parents to apply and replace their naturalization certificate before he could apply for his certificate?
-
Do we need to wait for my spouse to get a certificate of naturalization before applying for my green card?
-
Our lawyer wrote "Spouse has certificate of naturalization. Issue date/number is unknown" on Form I-130 and said "it's ok as long as he applies and gets the certificate before green card interview". Is that true?
-
Which form should he use to apply for this certificate? N-600, N-400 or N-565? (He doesn't remember whether he ever had the certificate so we don't know whether we are apply for replacement or a new certificate.)
Thank you!
